Restaurant Owner Fined For Serious Fire Safety Violations

A restaurant owner on Wellingborough Road, Northampton, has been fined after an inspection by Northamptonshire Fire and Rescue Service uncovered severe breaches of the Regulatory Reform (Fire Safety) Order 2005, putting employees at significant risk.

Investigation Reveals Major Safety Failures

The inspection, initiated by intelligence received by the fire protection team, revealed that the restaurant’s loft space was unlawfully being used as sleeping quarters for employees. Further investigations identified critical fire safety shortcomings, including:

  • No fire detection system
  • Inadequate escape and access routes

These failings created a substantial risk, leaving occupants vulnerable in the event of a fire. Consequently, a Prohibition Notice was issued in April 2023, prohibiting the use of the premises for sleeping accommodation.

Court Action and Sentencing

The restaurant owner appeared before Northampton Magistrates Court and pleaded guilty to the violations. The court imposed the following penalties:

  • A Community Order requiring 200 hours of unpaid work within 12 months
  • A victim surcharge of £114
  • Costs totalling £750

Fire Service Response

Scott Richards, Head of Protection at Northamptonshire Fire and Rescue Service, praised the swift actions of the fire protection officers. “When we received information about safety being compromised, our officers acted promptly to investigate and address the risks. Our priority is always to protect people, and we strive to work collaboratively with businesses to ensure compliance with fire safety standards.” Richards emphasised the severity of the case: “The breaches in this instance were so serious that prosecution was the only option. This sends a strong message that endangering lives is unacceptable.”

He also highlighted the court’s recognition of the risks involved: “We are pleased the Magistrates’ Court acknowledged the gravity of the situation and issued an appropriate sentence. This serves as a critical reminder to all businesses about the importance of fire safety and the consequences of non-compliance.” This case underscores the vital role of fire safety regulations in protecting lives and holding businesses accountable.
